1. Legal framework
This Cookie Policy is issued pursuant to:
Article 82 of the French Act No. 78-17 of 6 January 1978 on data processing, data files and individual liberties (“Loi Informatique et Libertés”), as amended, which transposes Article 5(3) of Directive 2002/58/EC of the European Parliament and of the Council of 12 July 2002 (the “ePrivacy Directive”) into French law.
Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (the “GDPR”).
The guidelines and recommendations of the Commission nationale de l’informatique et des libertés (CNIL), and in particular its recommendation on cookies and trackers adopted on 17 September 2020 (deliberation No. 2020-092).
Under French law and CNIL guidelines, any cookie or tracker that is not strictly necessary for the operation of the Site requires the prior, free, specific, informed and unambiguous consent of the user before being deposited on their terminal device. This applies regardless of whether the cookie processes personal data, and regardless of the legal bases available under the GDPR.
2. What are cookies and trackers
